Statement Sundance Film Festival

Earlier today certain media ran an item relating to a film included in the lineup of the Sundance Film Festival. The Estate issued the following statement to media reporting the story:

“This is yet another lurid production in an outrageous and pathetic attempt to exploit and cash in on Michael Jackson. Wade Robson and James Safechuck have both testified under oath that Michael never did anything inappropriate toward them. Safechuck and Robson, the latter a self-proclaimed ‘master of deception’, filed lawsuits against Michael’s Estate, asking for millions of dollars. Both lawsuits were dismissed. This so-called ‘documentary’ is just another rehash of dated and discredited allegations. It’s baffling why any credible filmmaker would involve himself with this project.”

Unfortunately, anyone can release a documentary and they do not have to secure permission to do so. The only time the Estate has any potential recourse is when a documentary or other film uses intellectual property such as music or video that is owned by the Estate and is not protected under “fair use” claims, which of course the Estate is monitoring. You may recall the Estate filed litigation against Disney earlier this year for violating its intellectual property rights.

As the Estate said, the individuals featured in this documentary have had their claims rejected in court.

Furthermore, Michael was declared innocent in the criminal case against him. No documentary can change that.

The Michael Jackson Estate to the Fan community.

The following is an additional statement from the Estate to the fan community about the film that was added to the Sundance Film Festival yesterday:

To the fan community:
First and foremost, Michael Jackson is our friend. We each have a long history with Michael and are passionate about making sure that the world sees the compassionate, spiritual and extraordinarily talented man that we know. It is our love for Michael that fuels our efforts to both entertain and educate the world about him as an artist and a human being.

It is also why we, as Michael’s friends and fans, are disgusted by the false accusations that continue to be repeated in an attempt to denigrate the reputation of our friend and to cash in on some small interaction with his life.

As we pointed out in our statement to the media last night and which has now been confirmed by others, this newest so-called ‘documentary’ features Wade Robson and James Safechuck – two disgruntled individuals who are admitted liars and who have testified under oath that Michael Jackson never did anything inappropriate to them. They are participating in this project only after their veiled attempts to extort monies from the Estate failed and, thanks to the efforts of the Estate’s legal team, their lawsuits against the Estate were dismissed. This is one more opportunistic attack on Michael’s vast legacy and stellar character by people looking to gain attention and benefit financially. It is pathetic.

Just like you, we want to shut down every single offensive story, documentary, book, and scurrilous accusation. However the Estate has to base its legal actions on what kind of claim it can make in a court of law. The law offers certain protections for Michael’s right of publicity but unfortunately, those protections do not extend to documentaries or other films about him. The Estate cannot sue for these libels and slanders of Michael because the law does not provide for civil lawsuits defaming a deceased person, no matter how malicious the lies about him are.

In most cases, we do have the ability to stop the infringement of copyrights in the materials owned by the Estate . If we find that is the case with this production, then as we did with the program that recently aired on ABC-TV where we filed a suit against Disney, the Estate will pursue those claims. If we file a lawsuit that is not permitted by law and thus we have no chance of winning, all we would be doing is giving these liars a public forum to repeat the false claims that have already been dismissed in court.

We will continue to do everything in our power as executors of the Estate. And fans should too. Voice your outrage to the people that run the Sundance Film Festival, the director/producer, Dan Reed, and/or HBO and UK Channel 4 who helped create this exploitive film . Share your thoughts and feelings. It is a disgrace that they are giving a platform to these to perjurers in a production that calls itself a documentary.

Here below the message from the Michael Jackson Estate regarding the upcoming Documentary:

Hello MJFam!

The past week has been a difficult one for the Estate just as we know it has been for you. We understand that the fans want to see the Estate take public action to stop the documentary screening at Sundance in the coming days but doing so isn’t necessarily the best or only way to counter the actions of these 2 admitted liars and their co-conspirators. The Estate is here to protect and grow Michael’s legacy, and that also means keeping the public focused on his music and the true Michael that we know through projects that will capture the hearts and attention of both fans and the general public.

In the coming weeks, the Estate will be sharing information about several partnerships that celebrate Michael’s life, art, and enduring influence – some are partnerships that the Estate has already told you about and others that have been in development and not yet acknowledged publicly. The first is the reveal of the invitation to Virgil Abloh’s Paris Fashion Week show, which was a single, sparkly glove, inspired by Michael. Read more about it in this piece on Vogue, which also says “The late, great Michael Jackson is set to be honored this Thursday in Paris…Jackson will be honored by one very high-profile, very pop culture–obsessed designer at the Fall 2019 menswear shows. Michael Jackson's Estate Shades HBO On Twitter Over "Leaving Neverland"

Michael Jackson's estate calls out HBO for disloyalty after the late singer gave them their highest ratings.

Although we remember Michael Jackson for the musical legend that he is, allegations of child molestation have had an impact on his legacy. Next week, HBO's Leaving Neverland documentary will premiere at the Sundance Film Festival before airing on HBO the week after. The estate of the late Michael Jackson already put HBO on blast, saying, “This is yet another lurid production in an outrageous and pathetic attempt to exploit and cash in on Michael Jackson." However, the estate's Twitter account threw more shade at the TV network on Twitter, claiming MJ gave HBO their highest-rated special ever.

Michael Jackson's estate is continuing to discredit HBO for their upcoming Leaving Neverland documentary which features two of Jackson's alleged molestation victims. On Twitter, the estate wrote, "In 1992, Michael gave HBO their highest rated special ever. Now, to repay him they give a voice to admitted liars. #StopLeavingNeverlandNOW," along with a poster for the concert that aired on HBO.

The new documentary follows the release of Lifetime's Surviving R. Kelly docuseries which explores the age-long allegations against R. Kelly. Although these allegations have been known for years, it shed new light on the victims and their stories. Leaving Neverland will focus on the stories of two of Jackson's alleged victims, who were 7 and 10 at the time of meeting the singer, and their families. Both alleged victims, who are now in their 30s, open up about the allegations and how they came to terms with it as adults.

MJ Estate verklagt HBO

Eine Verleumdungsklage bei Verstorbenen ist gemäss amerikanischem Recht nicht möglich, weshalb dem MJ Estate betreffend „Leaving Neverland“ die Hände gebunden sind. Abgesehen von den offensichtlichen Ungereimtheiten in den Behauptungen von Robson und Safechuck, haben die Nachlassverwalter gemäss ihrem Schreiben an HBO einiges in der Hand. Dennoch haben sie nun eine Möglichkeit gefunden, gegen HBO vorzugehen.

Heute Morgen wurde HBO vom MJ Estate wegen Vertragsbruches verklagt. HBO ist ein Co-Produzent von „Leaving Neverland“, der als „Dokumentarfilm“ angepriesen wird, obwohl keine unabhängigen Stimmen darin vorkommen. (Wade Robson und Safechuck hatten das Estate vor Jahren erfolglos auf hunderte Millionen Dollar verklagt.)

As many of you know, in 1992 HBO entered into an agreement for the broadcast of “Live From Bucharest” which became HBO’s highest rated special. As part of that agreement, HBO agreed to non-disparagement provisions which remain in effect. This program is the epitome of disparagement. Therefore, HBO stands in breach of contract. Even though Michael is not here to defend himself and there is no claim for defamation, this is a contractual obligation.

Please keep raising your voices online to let your local broadcasters know that airing these lies is a mistake, and the Estate will continue to fight to protect Michael’s legacy in the courts.

Michael Jackson Estate Sues HBO Over “Leaving Neverland” Citing Breach of Contract from 1992 Non-Disparagement Clause

HBO may yet have to reconsider broadcasting “Leaving Neverland.”

Today the Michael Jackson estate sued the cable company to prevent them from showing the controversial two part documentary. The Estate claims breach of contract stemming from a 1992 non disparagement clause HBO signed with Jackson when they produced one of his specials.

The Estate writes in the complaint: “In those non-disparagement provisions, HBO promised that “HBO shall not make any disparaging remarks concerning Performer or any of his representatives, agents, or business practices or do any act that may harm or disparage or cause to lower in esteem the reputation or public image of Performer.” Other provisions in the Agreement require HBO to notify and consult with Jackson and Optimum Productions if it wishes to air additional programming about Jackson. HBO agreed that the covenants by which HBO promised to be bound would run both during and “after HBO’s contact or HBO’s relationship with Licensor and/or Performer.”

The complaint zeroes in on Richard Plepler, who was then the head of the company’s corporate communications and today runs HBO.

“Plepler must have known, or should have known, about HBO’s contract with Jackson, as Michael Jackson in Concert in Bucharest: The Dangerous Tourwas the biggest event for HBO that year. Yet in his desperation, Plepler willfully ignored HBO’s obligations to Michael Jackson.”

They add: “HBO’s Film violates the plain words of Agreement with Jackson and Optimum: The Film makes false and “disparaging remarks concerning [Michael Jackson] [and] disparage or cause to lower in esteem the reputation or public image of [Michael Jackson].”

The Estate continues: “The fact that HBO’s CEO, Richard Plepler was fully aware of HBO’s contractual relationship with Jackson and Optimum and yet willfully ignored them is inexcusable. HBO’s airing of the film, including its double-faced depiction of the Dangerous World Tour, constitutes a malicious and willful breach of the anti-disparagement covenants in the Agreement. As Richard Plepler himself once said, ‘A lie goes halfway around the world before the truth puts its boots on, and we bear some responsibility for that.’ Indeed.”

I don’t know why HBO has gotten involved with “Leaving Neverland,” which I haven’t seen and can’t make a judgement about yet. I’ve known Richard Plepler a long time; he’s one of the good guys. But this is hardly the look HBO usually engages. This whole episode just rings with extreme negativity at a time when cable is fighting for its life vs. streaming and other innovations.

At the same time, “Leaving Neverland” has unleashed the rogues gallery of ex-Neverland employees from the 1990s who were totally unmasked as grifters. They sold their stories in the 90s and they continue to sell them now even though no court of law would recognize them. That part is really unnerving and venal.
